  INTER-MINISTERIAL CIRCULAR


To provide guidance for the implementation of a number of Articles in the Agreement between the Government of the Socialist Republic of Vietnam and the Government of New Zealand on the Working Holiday Scheme

Pursuant to the Agreement between the Government of the Socialist Republic of Vietnam and the Government of New Zealand dated 29th December 2011 on the Working Holiday Scheme (herein referred to as the Agreement);

Pursuant to the Decree No. 186/2007/ND-CP dated 25 December 2007 of the Government that stipulates the functions, responsibilities, competence and organization structure of the Ministry of Labour, Invalids and Social Affairs;

Pursuant to the Decree No. 77/2009/ND-CP dated 15 September 2009 of the Government that stipulates the functions, responsibilities, competence and organization structure of the Ministry of Public Security;

Pursuant to the Decree No. 15/2008/ND-CP dated 04 February 2008 of the Government that stipulates the functions, responsibilities, competence and organization structure of the Ministry of Foreign Affairs;

Pursuant to the Decree No. 21/2001/ND-CP dated 28 May 2001 of the Government that provides detailed regulations for the implementation of the Ordinance on the entry, residence and exit of foreigners in Vietnam. .

The Minister of Labour, Invalids and Social Affairs, the Minister of Public Security, the Minister of Foreign Affairs provide guidance for the implementation of a number of articles of the Agreement between the Government of the Socialist Republic of Vietnam and the Government of New Zealand on the Working Holiday Scheme as follows:

Article 1. Scope of application

1. This Circular stipulates the procedures for grant the working holiday permit (herein referred to as permit), visa and residence of New Zealand holiday makers in Vietnam.

2. This Circular shall be applied to all New Zealand citizens who work during their holiday in Vietnam (herein referred to as New Zealand citizens); organizations, agencies, enterprises (herein referred to collectively as employers) in Vietnam which employ New Zealand citizens.

 Article 2. Conditions to issue permit

The conditions in which a permit shall be issued for a New Zealand citizen under Article 5 of the Agreement and points (g) and (k), Article 5 shall be as follows:

1. The New Zealand citizen shall present a document which prove he/she has opened an account with a bank in New Zealand that are accessible through banks in Vietnam with a balance of not less than 4,200 NZD.

2. The New Zealand citizen has been issued with a health certificate stating that he/she is in good condition to work under the laws and regulations of New Zealand. The health certificate shall be issued not more than 180 days prior to the date of his/her application for the permit.

Article 3. Documents for application

A New Zealand citizen shall submit in person or by post 1 (one) dossier to the Embassy of Vietnam in New Zealand to apply for the permit. The dossier shall include:

1. The application form for working holiday permit for New Zealand citizens according to form 1 annexed to this Circular;

2. A photocopy of passport of the New Zealand citizen with an expiry date of at least 01 month as compared to the applied duration of the permit;

3. A health certificate as stipulated in paragraph 2, Article 2 of this Circular;

4. A National Certificate of Secondary Educational Achievement in New Zealand of second class or higher;

5. A Document of prove that he/she meets the financial requirement as stipulated in paragraph 2 of this Circular;

6. Three copies of a colour photo (size: 3cm x 4cm), with bare head, taken frontally, showing clearly the face and 2 ears and no glasses with white background, and a soft copy of the photo.

The documents required in paragraph 3, 4, 5 of this Article shall be originals; if otherwise, the documents shall be notarized or certified copies.

The above documents shall be in English and shall be exempted from consular legalization.

Article 4. Validity duration of the permit and visa

1. The validity duration of the permit shall be granted based on the request of the New Zealand citizen but shall not exceed 12 months.

2. The validity duration of the visa for the New Zealand citizen shall be the same as the permit.

Article 5. Procedures to grant the permit, visa and certificate of temporary residence

1. Procedures to grant the permit:

a) At least 30 days prior to the date of planned entry into Vietnam, the New Zealand citizen shall submit in person or by post the dossier to apply for the permit to the Embassy of Vietnam in New Zealand;

b) Within 5 working days since the date of receipt of the completed dossier submitted by a New Zealand citizen, the Embassy of Vietnam in New Zealand shall transfer to dossier to the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) by fax or email;

c) Within 10 working days since the date of receipt of the complete dossier, the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) shall inform the result of the application to the Embassy of Vietnam in New Zealand and the Embassy of New Zealand in Vietnam in writing.

2. Procedures to grant visa and certificate of temporary residence:

a) Within 2 working days since the date of receipt of the dossier, the Employment Bureau shall issue a communication in writing to the Immigration Department of Ministry of Public Security to consider grating visa to the New Zealand citizen according to the Form no. N2, issued in conjunction with the Inter ministerial Circular No. 01/2012/TTLT/BCA-BNG dated 03 January 2012 which amends and supplements the Inter ministerial Circular no. 04/2002/TTLT/BCA-BNG dated 29 January 2002 and the Inter-ministerial Circular No. 05/2009/TTLT/BCA-BNG dated 12 May 2009 of the Ministry of Public Security and Ministry of Foreign Affairs on immigration regulations, in addition with the granted permit of the New Zealand citizen.

b) Within 5 working days since the receipt of the communication from the Employment Bureau (Ministry of Labour, Invalids and Social Affairs), the Immigration Department (Ministry of Public Security) shall response with the result of visa application for the New Zealand citizen and shall inform the Embassy of Vietnam in New Zealand to grant visa. In case the visa application is rejected, the Immigration Department (Ministry of Public Security) shall reply to the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) in writing and clearly state the reason for rejection; the Employment Bureau shall then inform the Embassy of Vietnam in New Zealand to reply to the New Zealand citizen.

c) The New Zealand citizen shall enter Vietnam and shall be granted with the certificate of temporary residence by immigration officers at the border before entry into Vietnam. The duration of the certificate of temporary residence shall be granted in line with the duration of the visa.

Article 6. Delivery of the permit

Within 5 days since the entry of the New Zealand citizen into Vietnam, the New Zealand citizen shall receive the permit at the Office of the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) or at the Employment Service Centre of Ho Chi Minh City, affiliated to the Department of Labour, Invalids and Social Affairs of Ho Chi Minh City.

Article 7. Number of permits

Every year, the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) shall issue no more than 100 permits for New Zealand citizens who meet the conditions according to the Agreement.

Article 8. Design of the permit

1. The design of the permit shall be as follows:

a) Layout of the permit:

The permit is made in the size of 17.8cm x 12.5cm, consisting of 10 pages. The first and the 10th page are in dark pink colour, and coated with plastic; pages from 2 to 9 have white background, pink decorations and a star in the center.

b) The contents of the permit shall include particulars stated in the Form 2, annexed to this Circular.

2. The permit shall be printed and used consistently by the Employment Bureau (Ministry of Labour, Invalids and Social Affairs).

Article 9. Use of the permit

1. Within 05 working days since the New Zealand citizen starts to work for an employer, the employer shall have to certify in the permit following particulars: full name of the employer, location of the workplace, telephone number of the workplace, position, start date and end date.

2. The New Zealand citizen shall have the responsibility to keep the permit when the permit is valid.

3. The New Zealand citizen shall present the permit when undertake procedures with respect to his/her residence, entry and exit as requested by competent state authorities.

4. Within 03 working days since the employer certifies in the permit, the New Zealand citizen shall send a photocopy of permit with the employers’ certification as stipulated in paragraph 1 of this Article to the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) by post, fax or email.

Article 10. Re-issuance of the permit

1. A permit can be re-issued in the following cases:

a) the permit is lost;

b) the permit is damaged.

2. Documents for re-issuance of the permit:

a) Application form for re-issuance of the permit duly filled by the New Zealand citizen, according to Form 3, issued in conjunction with this Circular. The reason why the permit is loss or damaged should be clearly stated;

b) the issued permit in the case of point 1.b of this Article;

c) Three copies of a colour photo (size: 3cm x 4cm), with bare head, taken frontally, showing clearly the face and 2 ears, no glasses, with white background, and a soft copy of the photo.

3. The validity duration of the re-issued permit shall be the same as the issued permit.

4. Procedures for re-issuance of the permit:

a) Within 3 days after the permit is lost or damaged, the New Zealand citizen shall have to request the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) to re-issue the work permit by submitting, in person or by post, a dossier to apply for re-issuance of the permit.

b) Within 3 working days since the receipt of the complete dossier for re-issuance of the permit, submitted by a New Zealand citizen, the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) shall re-issue the permit and inform the New Zealand citizen. In case of rejection, the reply should be in writing and the reason for rejection should be clearly stated.

5. Delivery of the re-issued permit:

The New Zealand citizen shall receive the re-issued permit at the Office of the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) or at the Employment Service Centre of Ho Chi Minh City, affiliated to the Department of Labour, Invalids and Social Affairs of Ho Chi Minh City.

Article 11. Fee for issuance and re-issuance of the permit

New Zealand citizens shall have to pay fees for issuance and re-issuance of the permit at the place of delivery as provided by the Ministry of Finance.

Article 12. Cases of permit cancelation or nullity

1. The permit expires.

2. The permit is revoked by the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) for failures to comply with provisions of paragraph 4, Article 9 of this Circular.

3. The New Zealand citizen notifies the Bureau of Employment (Ministry of Labour, Invalids and Social Affairs) of his/her departure before the expiration date of the permit.

4. The New Zealand citizen is sentenced to imprisonment, dead or lost as declared by a court.

Article 13. Implementation responsibilities

1.     Responsibilities of the Viet Nam Embassy in New Zealand :

a)  Communication, dissemination of the regulations stipulated in this Circular to New Zealand citizens interested in the Working Holiday Scheme in Viet Nam;

b)  Receiving and transferring the application dossier of New Zealand citizens to the Employment Bureau (Ministry of Labour, Invalids and Social Affairs);

c)   Issuing visa to New Zealand citizens as prescribed by law, based on the decision of the Immigrant Department (Ministry of Public Security) on visa issuance.

2.  Responsibilities of the Immigration Department (Ministry of Public Security) :

a)  Considering and approving visa issuance to New Zealand citizens holding permit;

b)  Notifying the Employment Bureau (Ministry of Labour, Invalids and Social Affairs), Viet Nam Embassy in New Zealand on the approval or rejection of visa application by New Zealand citizens;

c)   Cooperating with the Employment Bureau (Ministry of Labour, Invalids and Social Affairs), the Consular Department (Ministry of Foreign Affairs) to handle violations by New Zealand citizens under this scheme against the Laws of Viet Nam on entry, exit and residence of foreigners in Viet Nam

3.  Responsibilities of the Employment Bureau (Ministry of Labour, Invalids and Social Affairs) :

a)  Receiving and processing applications for permit issuance or reissuance from New Zealand citizens;

b)  Issuing or reissuing permit to New Zealand citizens as authorized by the Minister of Labour, Invalids and Social Affairs;

c)   Requesting the Immigration Department (Ministry of Public Security) to consider and issue visa for New Zealand citizens holding permit;

d)  Informing the Embassy of Vietnam in New Zealand on the result of permit application;

e)   Informing the Embassy of Viet Nam in New Zealand, the Embassy of New Zealand in Viet Nam, the Immigration Department (Ministry of Public Security) and the Consular Department (Ministry of Foreign Affairs) at the completion of the annual quota of 100 permits and the termination of permit issuance to New Zealand citizens;

f)    Cooperating with the Immigration Department (Ministry of Public Security), Consular Department (Ministry of Foreign Affairs) to handle violations of New Zealand citizens under this scheme against the laws of Viet Nam on entry, exit and residence of foreigners in Viet Nam;

g)  Publicizing procedures; fees for permit issuance and re-issuance; number of permits granted; expiration or cancellation of permits and other relevant information on the website http://www.vieclamvietnam.gov.vn for reference of New Zealand citizens.

 

In case of expiration or cancellation of permits as stipulated in paragraph 2, 3 and 4, Article 12 of this Circular, the Employment Bureau shall inform the Viet Nam Embassy in New Zealand, the New Zealand Embassy in Viet Nam, the Immigration Department (Ministry of Public Security), Consular Department (Ministry of Foreign Affairs) and the New Zealand citizen.

 4.  Responsibilities of the Consular Department (Ministry of Foreign Affairs):

a)  Providing instructions to the Embassy of Viet Nam in New Zealand to implement provisions of this Circular;

b)  Cooperating with the Immigration Department (Ministry of Public Security), Bureau of Employment (Ministry of Labour, Invalids and Social Affairs) to handle violations of New Zealand citizens under this Scheme against the laws of Vietnam on entry, exit and residence of foreigners in Vietnam and regulations on New Zealand working holiday makers as within the competence, and responsibilities of the Department.

5.  Responsibilities of employers:

a)  Complying with laws and regulations of Viet Nam applicable to the New Zealand citizens;

b)  Certifying information in the permit with the particulars specified in item 1, Article 9 of this Circular and implementing the regulations on immigration and residency of foreigners in Viet Nam.

6.  Responsibilities of New Zealand citizens:

a)  Studying and complying with regulations stipulated in this Circular and other laws and regulations of Viet Nam;

b)  Submitting complete dossier of application for issuance and reissuance of the permit as regulated;

c)    Pay fees for the issuance and re-issuance of the permit; issuance of visa, charges for facsimileing the result of visa application from the Immigration Department (Ministry of Public Security) to the Embassy of Vietnam in New Zealand and other fees as prescribed by laws and regulations of Vietnam.

Article 14. Implementation

1. This Circular shall take effects as of 15 July 2012.

2. Any difficulties arising from the implementation of this Circular can be reported to the Ministry of Labour, Invalids and Social Affairs, the Ministry of Public Security and the Ministry of Foreign Affairs for timely guidance and revision./.
